1. Applicability of General Terms and Conditions
1.1 These general terms and conditions apply to all offers and quotations from, agreements with, supplies and services of the B&B.
Deviating clauses, agreements or arrangements only apply if and insofar as they have been confirmed in writing by the B&B. Verbal agreements and/or promises made by employees of the B&B are valid only if confirmed in writing by authorised employees of the B&B.
1.2 The B&B reserves the right to make changes to these general terms and conditions of sale, or to temporarily or permanently close the website or the online booking section, without prior notice or compensation. Therefore, we invite you to consult them regularly.
1.3 These general terms and conditions apply exclusively to legal relationships between the B&B and Customers, on the one hand, and, on the other, exclusively between the B&B and companies or respectively persons acting in the exercise of their profession.
2. Definitions
For the rest of this document, the terms below have the following meanings:
- “Receipt Confirmation” means e-mail sent by info@royalswans.be to the Customer to inform him that his reservation has been taken into account, including a summary of his reservation
- “Reservation Confirmation”: dematerialised document summarising the characteristics of the services reserved by the Customer on the site www.royalswans.be
The “B&B” means the Bed and Breakfast Royal Swans, with which the Customer has entered into a contract - Payment of the reservation amount by the Customer means that the Customer accepts the reservation confirmation, and this has the effect of binding him contractually to the booked B&B.
- “Customer” means natural person who has the legal capacity to commit to these terms and conditions and acts exclusively for his personal needs.
- “Sales conditions of the reserved rate”: the valid price on the date selected by the Customer for a room category with or without an option, linked to the payment and cancellation conditions
- “Reservation Request”: reservation request for rooms in B&B Royal Swans made by the Customer on the website royalswans.be.
- “Website” means electronic service operated by Royal Swans on the internet and accessible at the addresses listed in the preamble.
3. Offers, prices and tariffs
3.1 The offers and prices on the website may differ from the price actually in force at the time of booking. The B&B reserves the right to change prices and/or charge a supplement. The Customer shall be informed at the time of confirmation of the price valid at that time, and that price stated in the confirmation is the binding one.
3.2 All listings on the B&B website (www.royalswans.be) are deemed to be provided in good faith and are always subject to interim changes. The B&B is not bound by obvious errors on its website!
3.3 Prices always exclude costs a possible cancellation and/or travel insurance and any other costs, which shall be borne by the Customer.
4. Conclusion and content of the agreement
4.1 A contract between the B&B and the customer is formed by confirmation of a written or electronic (internet/email) booking of accommodation from the B&B’s current offer. The Customer booking must be of age. If there is availability, it will be confirmed within 72 hours. The B&B reserves the right to refuse a booking without giving reasons.
4.2 After booking and payment, Customer will receive a confirmation of booking by email which serves as proof of agreement. If no email address or a phone number suitable for SMS – messages can be handed over by Customer, a written confirmation will be sent by regular mail, whereby shipping costs will be charged.
4.3 De door de B&B verzonden boekingsbevestigingen bevatten relevante gegevens voor het verblijf in de geboekte B&B accommodatie. In het belang van een goede boeking en ter voorkoming van misverstanden dient de klant direct na ontvangst van de boekingsbevestiging of overeenkomst de gegevens op juistheid en volledigheid te controleren en eventuele onvolledigheden of onjuistheden binnen 24 uur na ontvangst aan de B&B te melden. Bij gebreke van een dergelijke melding binnen de gestelde termijn kan de klant geen beroep doen op de onvolledigheid of onjuistheid van de boekingsbevestiging/overeenkomst.
5. Payment
5.1 Payment of the booking to the B&B is made immediately upon booking by transferring the amount due to a designated bank account number with reference to booking number given by the owner and the guest’s name. The booking can only be confirmed after payment of the amount due. If the payment is not in the owner’s account within the specified time, the owner may accept another booking for this date and room, without the Client having any recourse or claiming compensation.
5.2 In the case of late bookings (within 48 hours of arrival), proof of payment must be delivered to the owner within the hour of booking. If this does not happen, the owner cannot guarantee that the room will be available.
5.3 In the event of full or partial non-payment on the due date, the outstanding amount shall be increased, ipso jure and without notice of default, by an interest rate of 12% per annum from the due date, with a minimum of €125.00, even if an instalment period is granted and without prejudice to the possibilities provided for in article 1244 of the Belgian Civil Code.
5.4 In any case and without prejudice to the above, non-compliance with the payment obligation shall have the effect of suspending the service and making all outstanding balances immediately due and payable. In case of dispute, only the courts of the jurisdiction to which the city of Bruges belongs have jurisdiction.
6. Cancellation and modification
6.1 The Customer is reminded, in accordance with Article L. 121-60 of the Consumer Code, that he does not have a right of withdrawal as provided for in Article L. 121-20-12 of the Consumer Code.
6.2 The Customer is entitled to cancel a booking in writing, without charge, more than 31 days before the date of arrival, unless the stay in the B&B accommodation falls within 31 days of the booking.
6.3 After the expiry of the period mentioned in 6.1, the Customer shall only be entitled to cancel in writing against payment of the fee under a. to c. stated cancellation charges:
a. From 30 days to 15 days before arrival, 50% of the booking fee will be retained, with a minimum of one night;
b. From 14 days to 8 days before the day of arrival, 75% of the total amount will be charged with a minimum of one night;;
c. From 7 days before the day of arrival or in the event of No Show (i.e. in the case of a reservation that has not been canceled but for which the customer has not appeared at the hotel on the reserved day), 100% of the total amount will be charged .
Monies already paid will be deducted from the cancellation fee to be paid.
6.4 Cancellation of a booking by the (main) Customer also counts as cancellation at the expense of fellow Customer(s).
6.5 Cancellation by the B&B: the B&B must provide the customer with an amendment proposal in the form of an alternative offer within 48 hours (2 working days) after serious circumstances have arisen. If this is not possible, the B&B will refund the booking fee paid by the Customer. Weighty circumstances constitute force majeure. Reference is also made here to the force majeure provisions in Art. 8. This obligation shall lapse if the cause of the change is attributable to the Customer.
6.6 All reservations are personal and can under no circumstances be transferred to a third party free of charge or against payment. Any reservation made for others must be made in the name of that third party.
6.7 The B&B charges a €30.00 administration fee for bookings that must be changed at the request of the Customer.
7. Rights and obligations of the Customer at the accommodation site
7.1 Local law shall always apply to the situation on site in addition to these terms and conditions and the contract. Unless otherwise stipulated by law, these conditions and the user agreement or internal regulations shall prevail. Clients must comply with the house rules, which are visibly posted in each room.
7.2 For arrivals before 16:00 or after 18:00, the Client should contact the owner in advance to discuss the possibilities of an early or late arrival (contact details see website).
7.3 Unless expressly provided otherwise, the Customer must vacate the room by 11:00 am after the last night of their stay. Otherwise, he will be charged an extra night.
7.4 The Client shall behave as a good user and use the B&B accommodation in accordance with the reasonable instructions for use given by the B&B or the owner at the Client’s first request and shall be deemed to have taken cognizance of the house rules present in each room.
7.5 Thus, in the entire B&B both inside and on all all terraces, patios and any other outdoor area, smoking is prohibited and no pets are allowed in the B&B.
7.6 The Customer accepts and undertakes to make reasonable use of the room and common areas of the hotel made available to him. Any kind of behaviour contrary to the principles of safety and/or hygiene, morality and/or public order may lead the Owner to ask the Customer to leave the establishment immediately without any compensation and/or without any refund if the Customer had already paid.
7.7 The customer is legally liable for the goods delivered by him or his fellow customers to the B&B. accommodation or the items therein caused damage. A claim must be reported by the Customer to the owner immediately. Repair and/or replacement costs shall be immediately reimbursed by the Customer to the Owner upon its first request.
7.8 Any item missing from the reserved room and noted by the hotel will be billed directly, i.e. an amount for its value.
Fines equal to the maximum price of the first reserved night will be imposed if the Customer fails to comply with the no smoking policy in their room.
7.9 The B&B provides free unsupervised common areas such as outdoor terrace and library exclusively for guests, unless otherwise stipulated by the owner. The use of these facilities and their equipment is the full and exclusive responsibility of the Customers who have free access to them, but only during opening hours.
If access is (temporarily) impossible for any reason, the Customer cannot claim any compensation or damages from the Owner.
8. Force majeure
The B&B cannot be held liable to the Customer in the event of non-performance of its obligations due to force majeure. In the event of force majeure, whether of a permanent or temporary nature, the B&B is entitled to terminate or temporarily suspend all or part of the agreement without the Customer being entitled to claim performance and/or compensation. Force majeure includes, but is not limited to: strikes, boycotts, cases of war, attacks, epidemics, disturbances in the energy circuit, in traffic and/or transport, government measures, hacking, bugs, unavailability of computer systems, scarcity of raw materials, natural disasters and furthermore all circumstances, extraordinary weather conditions, death of the owner, unannounced sale and/or occupation of the accommodation by the owner e. d. under which full or partial compliance with the agreement cannot reasonably and fairly be required of the B&B.
9. Liability
9.1 The photos on the website are not contractual. Even if every effort is made to ensure that the photos, graphics and text on the sites to illustrate the respective hotels give as accurate an overview as possible of the services offered by the accommodation, variations may occur, especially due to the change of furniture or possible renovations. The Customer cannot claim any damages in this regard.
9.2 In accordance with the laws and regulations relating to intellectual property rights, the use and/or reproduction of all or part of the elements of the offers on the Royal Swans website is strictly prohibited.
9.3 The B&B cannot be held liable for any loss suffered by the customer or third parties as a result of the stay in the accommodation; the customer indemnifies the B&B against any such claims. The B&B is not liable for disturbances in and around the accommodation such as failures and breakdowns of power and/or water supplies and/or technical installations, construction work not announced or announced in time and changes to access or main roads.
9.4 The customer is legally liable for any damage caused by him or his fellow customers to the B&B accommodation or the items therein. A claim must be reported by the Customer to the owner or manager immediately. Repair or replacement costs shall be immediately reimbursed by the Customer to the owner/manager upon first request.
9.5 The B&B is not responsible for theft, loss and damage of any kind during or as a result of the stay.
9.6 The B&B can only be held liable for loss that is attributable to its gross fault or negligence.
9.7 Notwithstanding the provisions of the previous paragraphs, if and insofar as the B&B is held liable at law under any aspect of the user agreement, its liability is always limited to direct loss and any form of consequential loss is excluded. Furthermore, the liability of the B&B is always limited to the maximum amount that its insurer will pay out in the relevant case.
10. Accessibility for people with wheelchairs
Despite all our efforts, there are exceptions to accessibility due to certain technical limitations. We advise you to contact the B&B prior to booking for detailed information on the options we can offer.
11. Privacy
The B&B will treat all personal data provided to it or becoming known as confidential and will not freely make them available to third parties.
12. Final provision
12.1 Unless otherwise stipulated by rules of international private law, the present conditions are exclusively governed by Belgian law. Non-Belgian Customers are deemed to have agreed to the terms and conditions. In case of dispute, only the courts of the jurisdiction to which the city of Bruges belongs have jurisdiction.
12.2 All disputes arising from the user agreement or these terms and conditions shall be settled in first instance by the competent court in Belgium, insofar as the rules of international private law do not provide otherwise.
12.3 Neither party may assign its rights and obligations to third parties to the extent not otherwise provided in these terms and conditions.
12.4 If and to the extent that any provision in the user agreement and these terms and conditions should prove to be void, the other terms and conditions shall remain in force and the void article shall thus be deemed to have been converted in such a way as to bring it into line with the parties’ apparent intentions.
